1. Acceptance of Terms

By accessing or using 1fund ("the Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms apply to all users, including supporters, campaign creators, and visitors.

We reserve the right to modify these Terms at any time. Material changes will be notified through our platform or via email. Your continued use after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

1fund is a reward-based crowdfunding platform that connects supporters with creators bringing new products and ideas to life. Our services include:

  • Hosting reward-based crowdfunding campaigns with a funding goal and deadline
  • Processing supporter payments through Xazna into 1Fund’s account
  • Operating an all-or-nothing funding model: a campaign only proceeds toward funding if it reaches its goal by its deadline
  • Providing campaign discovery, analytics, and progress-tracking tools
  • Offering communication tools between supporters and campaign creators

We act as an intermediary platform. We are not a party to the agreement between creators and supporters, we do not manufacture or deliver rewards, and we do not guarantee that any campaign will succeed or that rewards will be delivered as described.

3. User Accounts and Registration

3.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use our platform. By registering, you represent and warrant that you meet these requirements.

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete information
  • Updating your information promptly when changes occur
  • Notifying us immediately of any unauthorized access

4. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Post false, misleading, or fraudulent information
  • Engage in spam, harassment, or abusive behavior
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the platform's functionality
  • Use automated systems to access the platform without permission
  • Impersonate any person or entity
  • Solicit funds for illegal purposes

5. Reservations, Pledges, and Rewards

5.1 Nature of a Reservation and a Pledge

Supporters review the amount and explicitly pay through Xazna into 1Fund’s account. Earlier reservations remain expressions of interest, not payments. Only bank-confirmed payments unlock the project’s private Telegram group.

A pledge is a contribution to a creator's campaign in exchange for a promised reward. It is not an investment and not a retail purchase from 1fund. You acknowledge that:

  • Pledging does not grant you equity, ownership, profit share, or any financial return
  • Rewards may be delayed, modified, or in some cases not delivered
  • The campaign creator — not 1fund — is responsible for producing and delivering rewards
  • You should only pledge amounts you are comfortable contributing

5.2 All-or-Nothing Funding

Every campaign sets a funding goal and a deadline. If the goal is reached, the creator is responsible for fulfilling the promised rewards. If the goal is missed, full refunds are arranged manually by the 1Fund team with the bank. Refunds are not automatic; supporters can discuss requests in the project’s private Telegram group or contact support.

5.3 Your Own Judgment

We do not provide financial, legal, or tax advice. While creators pass identity verification (KYC) and campaigns are reviewed before going live, this review does not guarantee the accuracy of campaign information or the delivery of rewards. You are responsible for evaluating a campaign and its creator before reserving your interest or pledging.

6. Campaign Listings

6.1 Creator Responsibilities

If you create a campaign on our platform, you agree to:

  • Provide accurate and complete information about your campaign
  • Use funds solely for the stated purposes
  • Fulfill the rewards promised to your supporters
  • Comply with all applicable laws and regulations
  • Post regular progress updates (at least monthly) for your supporters

6.2 Campaign Moderation

We reserve the right to review, modify, or remove any campaign listing at our discretion. We may reject or remove campaigns that violate these Terms or our policies.

7. Fees and Payments

The checkout shows the amount payable through Xazna. Payment is recorded only after confirmation from the bank. We do not store your card details.

For successful campaigns, the configured platform fee is deducted from creator proceeds. Any required refund is handled manually with the bank. Creating a refund request in 1Fund does not itself transfer money; the team records completion after the bank processes the refund.

8. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, software, and design, are owned by 1fund or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

By posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating the platform.

9. Disclaimers and Limitation of Liability

9.1 Platform Availability

We strive to maintain platform availability but do not guarantee uninterrupted or error-free service. We may suspend or terminate access for maintenance, updates, or other reasons.

9.2 Limitation of Liability

To the maximum extent permitted by law, 1fund and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or pledged funds, arising from your use of the platform.

10. Indemnification

You agree to indemnify and hold harmless 1fund, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform will immediately cease, but provisions that by their nature should survive will remain in effect.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the platform shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless otherwise required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any legal action or proceeding shall be brought in the appropriate courts.
